AtCostWEB.com wants to ensure that all users of this web hosting service play fair and well within the law. The following guidelines are set to ensure the full enjoyment of the service by all customers.
AtCostWEB.com reserve the right to refuse and/or revoke service and/or incentives (including promotional items) at their discretion.
Customer Content
Your web space is your own to use as you wish, HOWEVER the following content will NOT be tolerated and your account will be closed without refund if you have violated any of the following guidelines:
* NO HATE SITES
* NO PORNOGRAPHY
* NO ILLEGAL CONTENT (i.e. WAREZ, PIRATED SOFTWARE, MP3, or any material in copyright violation)
* NO HACKING/PHREAKING related material that may promote willful harm to our servers or any other internet site or provider
* NO SPAMMING/BULK EMAIL
Any hosting client using their hosting account with AtCostWEB.com to send SPAM and/or be promoted by SPAMMING, will be subject to a USD$500.00 administrative fee for EACH SPAM complaint received.
AtCostWEB.com reserves the right to close the account and/or refuse connection to any offered services of any customer for any reason at any time and reserves the right, but is not obligated to review the account and to refuse or remove any such materials in its sole discretion, without notice at any time.
Security
Anyone found to compromising the security and standard operation of AtCostWEB.com servers or client sites will be prosecuted to the full extent of international law.
CGI Access and Other Web Applications
CGI scripts and/or other web applications found to be compromising the performance or security of the server will be shutdown without notice.
Resources
Any customer found to be exceeding an acceptable capacity of usage (cpu, bandwidth, space, email and/or otherwise) deemed by AtCostWEB.com, will have their account immediately suspended and/or may have their account moved to a different server and/or may be charged additional fees and/or have their account terminated and/or given the option to reduce usage.
All files in any hosting account must be relevant to the main site content. File storage, as deemed by AtCostWEB.com, is prohibited. Those customers using their hosting account for file storage will have their account immediately suspended. Dependent upon account usage and/or deemed by AtCostWEB.com some customers may require their site to be moved to a different server to ensure the full benefit of resources and services to all customers. This move may result in brief downtime for the specific site and related email.
All account activities may be monitored, recorded, and examined by any authorized person, including law enforcement.
Payment
Upon any credit card chargeback received by AtCostWEB.com, the associated hosting account will be indefinitely suspended, all web site, email files and domain names associated with that hosting account will become the property of AtCostWEB.com and any related bank or merchant fees incurred by AtCostWEB.com will be added to that hosting account's outstanding balance along with the amount of the chargeback itself and a USD$50.00 administrative fee. These additional fees must be paid by cheque within 30 days. Failure to do so may result in the outstanding balance of that hosting account being passed on to a third-party collections company with an additional 30% charge to cover collections costs and the site files may be deleted.
All hosting fees are subject to change without notice at the discretion of AtCostWEB.com.
Cancellation
To cancel any hosting plan, the client must fill-out the cancellation form in their client area.
Refunds
If any client cancels their hosting plan within 30-days of their initial order, all paid hosting fees will be returned. This does not include domain name registration fees, which are not refunded.
Any client who cancels a pre-paid (12mths, 24mths, 36mths) hosting account prior to the end of their term will have the used time of their account calculated at the premium monthly rate and then the remaining unused balance will be refunded.
Free Domain Names
Domain names that have been offered for free as part of a hosting plan which is canceled and refunded are charged at the current registration price and deducted from the refunded amount.
Indemnification
Customer agrees that it will protect, indemnify, save and hold AtCostWEB.com harmless from any and all stipulations, liabilities, losses, expenses and claims, as well as reasonable attorney's fees assessed against AtCostWEB.com, its agents, customers, officers, employees and administration that may arise or result from any service provided or performed or agreed to be performed or any product sold by it's customers, agents, employees or assigns. Customer agrees to defend, indemnify and hold AtCostWEB.com harmless against liabilities arising out of; (1) any injury to person or property caused by any products sold or distributed in association with AtCostWEB.com's Services; (2) any material furnished by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright violation and any defective products sold to a customer from AtCostWEB.com's Services.
Backups and Data Loss
Customer agrees to use this service at their sole risk. Backups done by AtCostWEB.com are a courtesy to the Customer and AtCostWEB.com is NOT responsible for any files and/or data residing in your account. Customer agrees to take full responsibility for their own files and data and agrees to accept full responsibility for maintaining backups of their own data and files.
Disclaimer
AtCostWEB.com will not be responsible for any damages your business may suffer. AtCostWEB.com makes no warranties of any kind, expressed or implied for services we provide. AtCostWEB.com disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by AtCostWEB.com and its employees. AtCostWEB.com reserves the right to amend or update these policies without notice. Failure to follow any terms and conditions may result in account deactivation.
In accepting services, customers indemnify AtCostWEB.com for the violation of any law or AtCostWEB.com policy, that results in loss to AtCostWEB.com or the bringing of any claim against AtCostWEB.com. This means that if AtCostWEB.com is sued because of activities of the customer that violate any law, or this policy, the customer will pay any damages awarded against AtCostWEB.com, plus costs and reasonable attorneys' fees.
